Hospital and care facility visits

We regularly notarize healthcare documents at OC hospitals, hospice facilities, skilled nursing homes, and assisted living communities. These visits require a bit more preparation:

  • Confirm with nursing staff that the patient is alert, coherent, and able to communicate willingness to sign
  • If capacity is in question, the notary may need to make an independent assessment — we cannot proceed if we cannot verify voluntary intent
  • Know the room number or unit before the appointment
  • Have the patient's photo ID available (or a passport if they don't have a driver's license)

California witness requirements

California's Advance Healthcare Directive requires either:

  • Two witnesses who are not healthcare providers, not heirs, and not the agent named in the document, or
  • A notary public (without witnesses)

Common questions

Do I need witnesses for a healthcare directive in California?

You need either two witnesses or a notary — not both. If you use a notary (us), no witnesses are required. Witnesses must not be your healthcare agent, an heir, or a healthcare provider. Notarization is typically the simpler and more reliable path.

How quickly can you come to a hospital?

For urgent situations, call directly at (949) 354-2660. We can typically respond within 1–2 hours during business hours. For after-hours emergencies, text us — we monitor messages evenings and weekends. An after-hours surcharge of $35 applies.

Can a patient with expired ID be notarized?

California law requires ID to be current or issued within the last 5 years. Expired ID cannot be accepted. If the patient does not have a valid ID, call us before booking — there are limited alternative identification methods available in some circumstances, such as credible witness identification.
